These Terms of Service (the "Terms") form a binding legal agreement between you ("you" or the "Customer") and Nozzl ("Nozzl", "we", "us" or "our") governing your access to and use of the Nozzl print-farm management platform, the website at nozzl.cloud, the desktop local agent, and any related applications, APIs, and services (collectively, the "Service"). By creating an account, checking the acceptance box, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 18 years old and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, in which case "you" refers to that organization.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete registration information, to keep it up to date, and to notify us promptly of any unauthorized use or suspected breach of security.
Nozzl provides a multi-tenant platform for monitoring, controlling, and managing 3D printers and print farms, including integrations with cloud and local (LAN) printers, queue and job management, telemetry, automations, and related tooling. Features may be added, modified, or removed over time. We may impose usage limits, throttle, or suspend features to protect the integrity, security, or availability of the Service.
You agree that you will not, and will not permit any user to:
You are solely responsible for the safe operation of your physical hardware. The Service issues commands to physical machines that can generate heat and moving parts; you must supervise your equipment and follow the manufacturer's safety guidance.
You retain all ownership rights in the models, designs, files, configurations, and other materials you upload or generate through the Service ("Customer Content"). You grant Nozzl a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Customer Content solely as necessary to provide and improve the Service.
You represent and warrant that you have all rights necessary to your Customer Content and that it does not infringe or misappropriate any third-party rights. You are responsible for maintaining your own backups; we are not liable for any loss or corruption of Customer Content.
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. When you connect third-party accounts (for example, printer cloud accounts), you authorize us to access and use those accounts on your behalf to provide the Service, subject to the applicable third party's terms. We are not responsible for the practices of third-party services.
Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor. By providing a payment method you authorize us to charge all fees due. Except where required by law, fees are non-refundable and are exclusive of taxes, which are your responsibility. We may change pricing on prospective notice; continued use after a price change constitutes acceptance. Failure to pay may result in suspension or termination.
The Service, including its software, design, and trademarks, is owned by Nozzl and its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes. All rights not expressly granted are reserved.
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. Features labeled beta, preview, or experimental are provided "as is" and may be changed or discontinued at any time. We may perform maintenance that temporarily limits availability.
You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure for us, or if required by law. Upon termination, your right to use the Service ceases and we may delete Customer Content after a reasonable period. Sections that by their nature should survive termination will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRINT JOB WILL COMPLETE SUCCESSFULLY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOZZL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, MATERIALS, OR DAMAGE TO PHYSICAL EQUIPMENT, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (EUR 100).
You agree to defend, indemnify, and hold harmless Nozzl and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Content, your use of the Service, or your breach of these Terms or applicable law.
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the competent courts located in the Netherlands for any dispute arising out of these Terms, except where mandatory consumer-protection law provides otherwise.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-app notice) and, where required, ask you to re-accept. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
